House Bill 2 Special Session Call

Good afternoon. Thank you for joining me here today, as we call the legislature into Special Session.

As many of you know, with the passage of House Bill 2 during the August Special Legislative Session, no effective date was provided within the text of the bill.

This error was not found until last week, and at that time, I asked legal counsel from my office to work with Legislative Services and the Attorney General’s office to determine if there was any way to provide for an effective date in this bill without calling the legislature back into session.

Following extensive legal review, it has been determined that there is no way to add an effective date to House Bill 2 without calling the legislature back into session.

Based on that information, today I am calling the legislature into a special session. The session will be held on September 13, beginning at 10:00 a.m.

This special session will be very focused. There is one task and one task only. I am asking the legislature to amend House Bill 2, to provide an immediate effective date and to provide a retroactive applicability date of August 26, 2002.

This call is to amend House Bill 2 to correct a technical error to conform the body of the bill to the title. I am confident that the legislature will act resolutely to complete this task in a timely manner.

Greg Pettisch from Legislative Services, and Budget Director Chuck Swysgood have joined me this afternoon in order to address technical questions about this session.
